Tally

Terms of Service

Effective 2 September 2026  ·  Last updated 2 September 2026

Tally is a mobile app for counting attendance at events and sharing those counts within a community. These Terms are the agreement between you and the developer of Tally. Please read them before you use the app.

1The agreement

Tally (the app) is published by MTS Studio, an independent developer. In these Terms, we, us and our mean MTS Studio; you means the person using the app.

By downloading, opening or using Tally, you accept these Terms. If you do not accept them, please do not use the app. Our Privacy Policy explains how we handle personal data and forms part of this agreement.

2What Tally does

Tally lets you:

Tally is a counting and record-keeping tool. It does not verify that the numbers you enter are correct, and it is not a payroll, ticketing, access-control or compliance system. You are responsible for deciding whether it fits your purpose.

3Who may use Tally

You must be at least 13 years old to use Tally. If you are under the age of majority where you live, you may use the app only with the involvement and consent of a parent or guardian, who accepts these Terms on your behalf.

If you use Tally for an organisation - a church, school, club, company or similar - you confirm you are authorised to accept these Terms for that organisation.

4Accounts

Some features - communities, shared events, announcements and emailed reports - require an account. To create one you give us a name, an email address and a password, and you confirm the address with a verification code we email you.

You can delete your account at any time from Profile → Delete Account in the app. Deletion is permanent - see our Privacy Policy for what happens to your data.

5Using Tally without an account

You can create and count events without registering. When you do, the app identifies you by a random identifier it generates on your device the first time you open Tally, and the events you create are linked to that identifier rather than to a person.

Please note

That identifier lives only in the app's own storage on that device. If you uninstall Tally, clear its data, or move to a new device, the identifier is lost and with it your ability to edit the events created under it. We have no way to restore that link or to prove the events were yours. If your records matter to you, create an account or join a community before you rely on them.

6Communities and shared data

A community groups events, members and announcements together. When you join one, or register a device to one, you should expect that other members of that community can see the events, groups, item names, attendance counts and announcements it holds - including the ones you create.

Community membership is managed within the app by the people who run that community. They decide who joins and who leaves. We do not mediate disputes between a community and its members, and we cannot re-assign ownership of a community on request.

7Your content

Event names, group and item names, counts, community details and announcements are your content. You keep whatever rights you already have in it. We claim no ownership.

So that the app can work, you give us a non-exclusive, worldwide, royalty-free licence to store, copy, transmit and display your content for the sole purpose of operating Tally for you and for the community you share it with - for example, syncing counts between devices, showing an announcement to community members, or compiling the attendance report you asked us to email. This licence exists only to run the service. It ends when you delete the content or your account, except for copies held in routine backups until they age out.

You are responsible for your content, including whether you have the right to post it.

8Data about other people

Read this if you run a community

Attendance records describe other people. If you use Tally to record how many people attended, which groups they belonged to, or anything else about them, you - not we - decide what to record and why. You must have a lawful basis for doing so, tell those people what you are collecting where the law requires it, and honour any request they make about their own information.

We provide the tool; you are responsible for how you use it. Keep records no more detailed and no longer than you actually need. If someone asks you about information you recorded through Tally, that request is yours to answer.

9Acceptable use

You agree not to:

10Emailed reports

A community can request an attendance report covering a range of months. The report is compiled on our servers and delivered by email; the request is queued rather than answered immediately, so the message may arrive some minutes later.

Report requests are rate-limited - roughly one every five minutes per community - to keep the service usable for everyone. A request made during that window is refused, and the app will tell you when you can try again. Do not attempt to work around this limit.

Reports go to the address held for the community. Make sure that address is correct and belongs to someone entitled to see the figures, because we cannot recall an email once it has been sent.

11Availability and changes

We aim to keep Tally running and useful, but we do not promise it will be uninterrupted or error-free. Maintenance, updates, network problems, app-store policies and matters outside our control can all interrupt it.

We may add, change or remove features, and we may stop offering the app altogether. If we plan to discontinue Tally or remove something you rely on, we will give reasonable notice where we practically can - through the app, or by email to registered users - so you can export or record what you need.

Some features need an internet connection. You are responsible for your own device and data charges.

12Third-party services

Tally relies on services we do not control - Google Firebase for community announcements, an email provider for report delivery, and the app store you installed from. Your use of those services is also governed by their own terms, and their availability affects ours.

Where the app opens an external link, we are not responsible for the content or practices of the site it takes you to.

13Suspension and termination

You may stop using Tally at any time by deleting the app, and you may delete your account from within it.

We may suspend or terminate your access if you materially breach these Terms, if your use puts the service or other users at risk, or if we are required to by law. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to put things right first.

Sections that by their nature should outlive the agreement - your content licence for copies already made, acceptable use, disclaimers, limitation of liability and indemnity - survive termination.

14No warranty

Tally is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

In particular, we do not warrant that attendance counts, totals, capacities or reports are accurate or complete. They reflect what users entered. Do not rely on them as the sole record for any purpose where an error would matter - keep your own.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only as far as the law permits, and your statutory consumer rights are unaffected.

15Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost goodwill, or lost or corrupted data, arising out of or relating to your use of Tally - even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for all claims relating to Tally is limited to the greater of the amount you paid us for the app in the twelve months before the claim arose, or USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

16Your responsibility to us

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, from your content, or from your use of Tally to collect or record information about other people. We will tell you promptly of any such claim and will not settle it without your agreement, which you will not unreasonably withhold.

17Changes to these Terms

We may update these Terms as the app changes. When we do, we will revise the "Last updated" date at the top of this page. If a change materially reduces your rights or materially increases your obligations, we will give notice through the app or by email to registered users before it takes effect.

Continuing to use Tally after a change takes effect means you accept the revised Terms. If you do not accept them, please stop using the app and delete your account.
